What Happened To That Trillion Dollars?

Fraud or Misrepresentation must be specifically plead to the requirements: (1) material representation that is not true; (2) reasonable reliance on that misrepresentation; (3) injury in the form of financial injury [damages] from the reasonable reliance.  Fraud can be shown by slight circumstances which taken as a whole show a scheme.  The Securities And Exchange Commission is using the Cause of Action against Madoff associates [LINK] and of course I post it here because the COA might possibly apply to a broad range of investment and business deals gone bad.

Another Protocol Breach Against the President

One cannot wonder but why President Obama in his addresses to Congress seems to have audience members who think a complete breach of protocol is appropriate, the latest being no less than a Supreme Court Justice.  Justice Alito’s conduct was a breach of protocol and intemperate, the later criticism being probably the worst non-nepharious thing that can be said about a Judge.  Of course the cynic would say stop avoiding the 600 pound gorilla in the middle of the room, yes, it is all  about,  and nothing but about,  the President’s race that  sparks the intemperance of  people who should know better.

A Federal Judge in Pennsylvania has recently ruled that an Insurance Company and its Agents are distinct entities under the law and therefore may be averred to be conspirators in a Racketeering Claim [RICO] , rejecting the defense argument that they are one and the same and thus cannot be conspirators.  RICO claims carry by statute treble damages plus attorneys fees.

These are not my words but the words of a New York Judge that just blasted Wall Street during the sentencing phase of a corruption trial.  the New York Judge stated that the system was failed in every respect from a total lack of oversight to moral less companies and ignorant investors.  May be a sign of the times.  The strength of the United States used to be its financial markets.

Drive Friendly Is A Thing Of The Past?

Growing up in the Stephenville area of Texas I remember liking the driving slogan for Texas at that time which was “Drive Friendly”. Tejas meant as I recall “friend” and so it seemed natural to the children of the state that drivers would be encouraged to drive friendly. How times have changed ~ road rage, tailgating, impatient drivers wanting inexplicably in almost a pathelogical frenzy to get a car length or two ahead of you! And today Texans are comfortable with the slogan “Don’t Mess With Texas”?
Vehicle collisions are not normal and never have been normal. They are rare and almost always caused by agressive driving or inattentiveness that borders on bizzarre.
It is the insurance industry that has tried to normalize collisions and in a propaganda campaign that would have made J. Gobbels blush they assert that they are routine. How many have you been in? It is time to think in a big picture way about Insurance/big money/global financing/ control of the media and make one’s own conclusions
